Disclaimers
Last updated: May 14, 2026
Honest expectations make better partnerships.
ScaleUpMedia discusses software, startups, artificial intelligence, automation, marketing, venture building, operating results, and client outcomes across our website, newsletter, social channels, sales materials, media appearances, and other communications.
This page explains the disclaimers and disclosures that apply to those communications.
We publish these openly because we believe clear expectations create better client relationships, stronger partnerships, and more responsible venture building.
1. No Guarantee of Results
ScaleUpMedia provides software development, marketing, automation, growth, and venture-partnership services with reasonable skill, care, and operator-grade attention.
We do not guarantee specific business, financial, technical, marketing, investment, or operational outcomes from our work.
Specifically, ScaleUpMedia does not guarantee:
- That any product we build will achieve product-market fit.
- That any venture we build, support, or co-operate will reach a specific revenue level, valuation, user count, growth rate, funding milestone, or exit.
- That any marketing campaign will produce a specific number of leads, customers, conversions, sales, or revenue.
- That any automation, AI agent, workflow, or software system will produce specific cost savings, efficiency gains, headcount reduction, or operational improvement.
- That any client, operator, partner, or venture will achieve results similar to those referenced in our marketing, case studies, portfolio, newsletter, or public content.
Software and venture outcomes depend on factors outside of our control, including market conditions, competition, customer behavior, client decisions, execution quality, product-market fit, third-party platforms, platform policies, economic conditions, and external infrastructure.
We commit to doing the work described in signed agreements. We do not guarantee outcomes that depend on the market.
2. Startup and Venture Risk
Most new software ventures are risky. Many fail, pivot, stall, or never reach sustainable revenue.
ScaleUpMedia is in the business of giving operators and founders a structural advantage in the early stages of building software, automation systems, and venture infrastructure. We aim to compress timelines, reduce wasted capital, improve execution speed, and ship production-grade work faster than traditional alternatives.
That structural advantage does not eliminate startup risk.
Ventures we build, market, support, invest in, or co-operate may fail. Some ventures may lose money. Some may never reach meaningful adoption. Some may require additional capital, strategic pivots, or long timelines before producing results.
You should assume that any new venture, software product, or growth initiative carries meaningful risk.
3. Earnings, Revenue, and Income Disclaimer
ScaleUpMedia may reference revenue figures, user counts, growth metrics, customer counts, valuations, exits, funding amounts, income figures, or other performance-related numbers in our website, marketing copy, newsletter, social content, sales materials, case studies, or media appearances.
These references are provided for historical, educational, or illustrative purposes only.
They are not promises, projections, warranties, guarantees, or representations that any other client, operator, venture, campaign, or project will achieve the same or similar results.
This applies to references involving:
- ScaleUpMedia.
- Matt Ganzak.
- ScaleUpMedia clients.
- ScaleUpMedia portfolio companies.
- Venture Partnership engagements.
- Software products built or supported by ScaleUpMedia.
- Marketing campaigns run or supported by ScaleUpMedia.
- Automation systems or AI-agent workflows built or supported by ScaleUpMedia.
Results vary widely based on the operator, market, timing, offer, product, audience, competition, capital, execution, pricing, sales process, customer demand, technology, and many other factors.
Any numbers shown are examples of what happened in specific circumstances. They should not be interpreted as typical, expected, average, or guaranteed results.
4. Project Scoring Is Non-Binding
ScaleUpMedia may provide a project scoring tool at app.scaleupmedia.com.
The scoring tool may use internal systems, artificial intelligence, automation, proprietary logic, and ScaleUpMedia evaluation frameworks to produce an initial assessment of submitted project ideas.
Project scoring may include:
- Feasibility commentary.
- Suggested scope.
- Indicative pricing.
- Timeline estimates.
- Fit assessment.
- Technical considerations.
- Venture or growth commentary.
Project scoring output is non-binding for both parties.
The scoring tool's output does not constitute:
- A formal proposal.
- A quote.
- An offer.
- An acceptance.
- A commitment to perform work.
- A commitment to enter into an engagement.
- Legal, financial, investment, technical, or professional advice.
Indicative pricing is an estimate only. Actual pricing, scope, deliverables, timelines, and payment terms are determined only through a signed Engagement Contract.
AI-generated scoring may contain errors, omissions, inaccuracies, outdated assumptions, or incomplete analysis. Submitting a project for scoring does not entitle the submitter to services, follow-up, or an engagement with ScaleUpMedia.
5. Work Begins Only After Contracts Are Signed
No paid work, engagement services, deliverables, ownership transfer, production development, marketing execution, venture partnership, revenue-share arrangement, equity arrangement, or operational commitment begins unless and until:
- A formal Engagement Contract has been signed by both parties.
- Initial payment requirements in the Engagement Contract have been satisfied, if applicable.
- Required onboarding steps have been completed.
- Any required confidentiality, access, security, or compliance steps have been completed.
Conversations, emails, demos, project scoring, pre-contract calls, estimates, presentations, strategy discussions, and exploratory communications are not binding unless incorporated into a signed Engagement Contract.
Verbal statements, email exchanges, proposal drafts, pricing discussions, or scoring results do not create a contractual relationship.
The Engagement Contract is the governing document for paid work between ScaleUpMedia and a client.
6. AI Output Disclaimer
ScaleUpMedia may use artificial intelligence systems, automation workflows, agents, internal tools, third-party AI providers, and proprietary systems, including The Machine and its subsystems, to assist with project scoring, software development, copywriting, analysis, research, automation, operations, and other services.
AI-assisted output may include code, copy, strategy, designs, workflows, summaries, research, analysis, recommendations, and operational suggestions.
Although ScaleUpMedia may use human review and quality-control processes, AI systems can produce:
- Errors.
- Inaccuracies.
- Incomplete analysis.
- Unexpected behavior.
- Biased or outdated outputs.
- Code defects.
- Security issues.
- Incorrect assumptions.
- Unsupported recommendations.
AI output should not be treated as legal, financial, tax, medical, investment, regulatory, compliance, or other specialized professional advice.
Clients are responsible for reviewing and approving outputs used in their business, especially where outputs relate to regulated industries, customer communications, financial decisions, healthcare, education, employment, payments, legal obligations, privacy, security, or compliance.
Specific responsibility, warranties, acceptance standards, review processes, and liability for AI-assisted work are governed by the applicable Engagement Contract and ScaleUpMedia's Terms of Service.

They are not guarantees.
Actual results may differ materially due to factors outside our control, including market conditions, competition, client decisions, customer demand, capital availability, technical constraints, regulatory developments, third-party platforms, economic changes, and execution risk.
You should not rely on forward-looking statements as promises or guarantees of future performance.
8. Testimonials and Case Studies
ScaleUpMedia may feature testimonials, reviews, endorsements, case studies, client stories, portfolio examples, or specific results from clients, partners, operators, or ventures.
These materials reflect the experience of the specific person, client, project, or venture described.
They are not guarantees that every client, operator, project, or venture will achieve the same or similar results.
Results described in case studies depend on the facts and circumstances of that engagement, including market conditions, offer quality, timing, budget, operator execution, audience, competition, product-market fit, and other variables outside of ScaleUpMedia's control.
Where required by law, ScaleUpMedia will disclose material relationships related to testimonials or endorsements, including active engagements, equity arrangements, revenue-share arrangements, affiliate relationships, compensation, or other material connections.
Unless expressly stated otherwise, testimonials are not paid endorsements.

Any such arrangement is governed only by the specific Engagement Contract and any related operating agreement, equity agreement, revenue-share agreement, profit-share agreement, investment agreement, or other written document signed by the parties.
You should consult your own legal, tax, financial, investment, and business advisors before entering into any financial, equity, revenue-share, profit-share, or venture-related arrangement with ScaleUpMedia.
Do not rely on marketing copy, conversations, project scoring, public content, or informal communications as the basis for any investment or financial decision.

Third-party links are provided for informational convenience only.

A link to a third-party website does not imply endorsement, sponsorship, affiliation, approval, partnership, or responsibility unless expressly stated.
Your use of third-party websites, tools, platforms, or services is governed by the terms and policies of those third parties.
11. Professional Advice Disclaimer

You should consult qualified professionals before making decisions that require specialized advice, including decisions involving securities, taxes, legal obligations, healthcare, regulated industries, employment, privacy, compliance, or financial risk.
12. Platform, API, and Third-Party Dependency Disclaimer
Many software products, automation workflows, marketing systems, and AI-agent deployments depend on third-party platforms, APIs, tools, marketplaces, data providers, app stores, advertising networks, payment processors, social platforms, hosting providers, and model providers.
These third parties may change pricing, policies, access rules, algorithms, APIs, rate limits, technical requirements, compliance obligations, or availability at any time.
ScaleUpMedia is not responsible for third-party changes, outages, policy updates, suspensions, API deprecations, pricing increases, account restrictions, or platform decisions that affect a product, campaign, workflow, venture, or deliverable.

Results are not typical and should not be expected.
